Cardpeer is an online platform exploited by Minefort.com B.V., a Dutch company having its principle place of business at Sloterweg 796, (1066 CN) Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce under number 89383001 (“Cardpeer”). For the avoidance of doubt, whenever hereafter reference is made to Cardpeer, Minefort.com B.V. is included in this reference.

Cardpeer is an independent, unofficial marketplace. Cardpeer is not affiliated with, endorsed by, authorized by, or sponsored by any card game brands or publishers, including but not limited to Pokémon, Nintendo, Creatures Inc., GAME FREAK Inc., Wizards of the Coast, Eiichiro Oda/Shueisha, or Toei Animation. All trademarks, service marks, trade names, product names, and logos appearing on the Service are the property of their respective owners. Any use of such trademarks or copyrighted material is for identification and reference purposes only and does not imply any association with the trademark holder of their product brand.
Cardpeer is an online platform that provides marketplace services by enabling Users to enter into agreements with other Users regarding the sale and purchase of physical trading card game products (such as single cards, sealed products and related accessories) (the "Service"). These general terms and conditions (the "Terms of Service") apply to all our Services and govern the use of Cardpeer. By using Cardpeer you acknowledge and accept applicability of these Terms of Service, including future modifications thereof.
Please read these Terms of Service carefully before using the Service. By using or accessing the Service, you agree to all the terms and conditions stated in these Terms of Service and a service agreement between Cardpeer and you as a User (as defined hereafter) comes into force (the "Agreement"). If, at any time, you do not or cannot agree to these Terms of Service, you must stop accessing or using the Service.
1. Definitions and scope
In these Terms of Service:
- User means any natural person using the Service, including buyers and sellers.
- Seller means a User (including an organization/seller account) offering Products on the Service.
- Buyer means a User purchasing Products on the Service.
- Product means a physical trading card game product offered on the Service.
- Listing means a Seller’s offer for sale of a Product on the Service.
- Order means a purchase placed by a Buyer on the Service for one or more Listings.
- Condition means the physical condition level selected by the Seller (e.g., Poor, Played, Light Played, Good, Excellent, Near Mint, Mint) and any additional notes.
These Terms of Service govern your use of the Service and the contractual relationship between you and Cardpeer in relation to the operation of the marketplace. The purchase contract for Products is concluded directly between Buyer and Seller (see Section 5).
2. Conditions relating to use of the Service
No individual under the age of 18 (eighteen) may use the Service, regardless of any consent from your parent or guardian to use the Service.
You need a supported web browser to access the Service. You acknowledge and agree that Cardpeer may cease to support a given web browser and that your continuous use of the Service will require you to download a supported web browser. You also acknowledge and agree that the proper performance of the Service is dependent on the performance of your computer equipment and your internet connection.
You agree to sign on and register for the Services directly through Cardpeer. You are solely responsible for managing your account and password and for keeping your password confidential. You are also solely responsible for restricting access to your account.
You agree that you are responsible for all activities that occur on your account or through the use of your password by yourself or by other persons. If you believe that a third party has access to your password, you should immediately change your password and contact support.
Cardpeer may modify its functionalities and processes at its sole discretion. You will only make physical items available for sale at the Service if you are entitled to sell these items. You acknowledge and agree that Listings must be accurately described, including relevant attributes such as language, edition/printing, condition, and any material defects (e.g., bends, creases, whitening, dents, surface damage, writing, missing components, reseals). For graded cards, Sellers must disclose the grading company and grade and must not misrepresent slabs or certifications.
You shall not engage in misleading listing or pricing practices (including price switching, bait listings, or materially incorrect product identification). Cardpeer may remove listings, suspend transactions, and/or restrict or terminate accounts where such conduct is suspected.
Cardpeer is not a re-seller of goods. Cardpeer acts solely as intermediary and is not a party to any agreement that may come into force through the use of the Service. Such purchase agreements shall become effective between the seller and the buyer of an item and are brokered by Cardpeer. Goods sold and purchased through use of the Service must comply with Cardpeer's listing, condition and shipping guidelines. Cardpeer is not liable for loss of funds or goods resulting from decisions made by third parties that provide services necessary for the operation of Cardpeer (e.g. payment providers).
Your use of the Service is subjected to the following conditions. You agree not to: (a) impersonate or misrepresent your affiliation with any person or entity including Cardpeer; (b) access, tamper with, or use any non-public areas of the Service or Cardpeer's computer systems; (c) attempt to exploit any vulnerability of the Service or any related system or network or breach any security or authentication measures used in connection with the Service and such systems and networks; (d) harm or threaten to harm other Users in any way or interfere with, or attempt to interfere with, the access of any User, host or network, including without limitation, by sending a virus, overloading, flooding, spamming, or mail-bombing the Service; (e) provide payment information belonging to a third party; (f) use the Service in an abusive way contrary to its intended use, to Cardpeer's policies and instructions and to any applicable law or regulation; (g) systematically retrieve data or other content from the Service to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise; (h) make use of the Service in a manner contrary to the terms and conditions under which third parties provide facilities and technology necessary for the operation of the Service; (i) infringe third party intellectual property rights when using or accessing the Service, including but not limited to making available items (including counterfeit products, illegal “proxy” cards represented as genuine, or infringing reproductions) or using registered trademarks while using the Service; (j) make use of, promote, link to or provide access to materials deemed by Cardpeer at its sole discretion to be offensive or cause harm to Cardpeer's reputation, including, but not limited to, illegal content and pornographic content and content deemed offensive or injurious to Cardpeer and/or the Service; and (k) access, or utilize, any functionality of the Service if you are related to a country embargoed or sanctioned by the US government or the European Union provided that such measures prohibit Cardpeer from providing the Service to you.
Cardpeer grants you the personal, non-transferable, non-exclusive, revocable and limited right to access and use the Service for your own personal purposes as an individual consumer ("Users").
Cardpeer has the unlimited right to investigate and prosecute violations of any of the above to the fullest extent of the law. Cardpeer may involve and cooperate with law enforcement authorities in prosecuting Users who violate this Agreement. You acknowledge that, although Cardpeer has no obligation to monitor your access to or use of the Service, it has the right to do so for the purpose of operating the Service, to ensure your compliance with this Agreement, or to comply with applicable law or regulation or the order or requirement of a court, administrative agency, or other governmental body.
3. Privacy
Cardpeer collects information about your account (such as name, shipping address, email, items sold and purchased), and is hereafter referred to as "Personally Identifiable Information". Cardpeer will never share your private information with anyone except as part of our privacy policy that further elaborates on this issue and can be found at /privacy-policy .
Personally Identifiable Information is used internally by Cardpeer to deliver, develop and improve products, content and Services, to which Users have subscribed, and to answer Users’ requests. In addition, Cardpeer may allow third parties performing services under contract with Cardpeer located in and outside the European Union, to access and use Personally Identifiable Information, but only to the extent necessary to provide the Service.
External websites and companies with links to and from Cardpeer online sites and products may collect personally identifiable information about Users when Users visit their websites. Cardpeer privacy policy does not extend to external websites and companies or third party publishers with links to or from Cardpeer products, services and online websites. Please refer directly to these companies and websites regarding their privacy policies.
4. Fees and payment
Registering with Cardpeer is free of charge. Cardpeer shall charge for its marketplace services a User that is selling items 5% (eight per cent) of each selling price per transaction, with a minimum of 0.01 EUR (one euro cent) (the "Fee"). Cardpeer has the right to change its Fee from time to time at its sole discretion. In the event Cardpeer increases its Fee, Cardpeer will notify its Users thereof one week in advance. Items that are already listed prior to the date the new Fee becomes applicable, shall remain subjected to the previous lower Fee. In the event Cardpeer lowers its Fees, already listed items will also immediately benefit.
The Fee is deducted automatically from the Seller’s sale price. Cardpeer may also charge additional fees (for example, a Buyer Protection fee charged to the Buyer and shipping costs) as shown during checkout.
Cardpeer may charge all applicable fees on sales and/or purchases associated with your Cardpeer account, where applicable. You are responsible for providing Cardpeer valid and up-to-date information for making and receiving payments.
Payments are processed through third-party payment providers. Where Seller payouts are offered, Sellers may be required to complete onboarding and verification with Cardpeer’s payment partners and provide accurate payout details. Payouts can be delayed due to verification, fraud prevention, chargebacks, compliance obligations, or other requirements imposed by payment providers and applicable law.
Cardpeer accepts no liability to complete any transaction which cannot be cleared by our payment processors, whether because there are no sufficient funds available on your credit card, issues related to identity or localization or otherwise. Cardpeer reserves its right to verify and approve any and all transactions made by you when using the Service. You expressly acknowledge and agree that such verifications may require you to provide Cardpeer with additional personal information in order to verify and confirm your identity and to perform verifications aimed to deter fraud and misuse of the Service. Cardpeer may suspend your account and contact you so you can provide Cardpeer with additional information required to process payments. Such suspension shall not relieve you from your obligation to pay any fees owed to Cardpeer.
Prices and fees are shown in the currency displayed on the Service and/or at checkout. Cardpeer and its payment providers may apply currency conversion where required. Any applicable taxes (including VAT, if applicable) and shipping costs will be shown at checkout where possible; customs duties and import charges for international shipments may be payable by the Buyer.
Users can list items for sale on the Service for a minimum price of 0.02 EUR (two euro cent) and a maximum price of 35.000 EUR (thirty-five thousand euro).
If you believe there is an issue with a payment or an Order, you should contact Cardpeer support first so we can investigate and help resolve it. Nothing in these Terms limits any mandatory rights you may have under applicable law.
5. Conclusion of contract between Users (marketplace model)
A Listing constitutes a legally binding offer by the Seller to sell the Product under the terms shown in the Listing (including price, condition and any shipping method offered). An Order is considered the Buyer’s acceptance of that offer, subject to successful payment and Seller fulfillment.
Cardpeer is not a party to the purchase contract between Buyer and Seller. Cardpeer provides the technical platform and may support Users in resolving disputes as described in these Terms and our policies.
6. Listings, Product descriptions and condition standards
Sellers must ensure that all Listings are complete, accurate and not misleading. Sellers are responsible for selecting the correct Product and for disclosing all information that a reasonable Buyer would consider relevant.
Sellers must select a Condition level that reasonably matches the Product’s actual physical state. When in doubt, Sellers must select a lower (worse) Condition and disclose specific defects in the listing notes.
Prohibited Listings include (without limitation): counterfeit products; items represented as genuine when they are not; stolen goods; items violating applicable law; items that materially infringe third-party rights; and listings that misidentify edition, language, printing, or other core attributes.
Counterfeit items. If Cardpeer receives or obtains access to a Product (including as part of a dispute, return, contract reversal, authenticity check, or investigation) and Cardpeer reasonably suspects that the Product is counterfeit, fake, altered, or otherwise not genuine, Cardpeer may retain the Product for verification and evidentiary purposes. If Cardpeer (or a third-party verification partner) determines that the Product is counterfeit/fake, you authorize Cardpeer, to the extent permitted by applicable law, to (a) permanently retain the Product, (b) hand it over to law enforcement, postal operators, rights holders, insurers, and/or other competent authorities, and/or (c) destroy or arrange for destruction of the Product to prevent further circulation of counterfeit goods. The Seller shall not be entitled to compensation for counterfeit items and Cardpeer has no obligation to return counterfeit items to any User.
Cardpeer may suspend or terminate Seller accounts involved in counterfeit activity, reverse or cancel affected transactions, and share relevant information with payment providers and competent authorities where appropriate and lawful.
7. Shipping, delivery and risk of loss
Sellers are responsible for packaging Products appropriately for safe transport (e.g., sleeves/toploaders/team bags for single cards, adequate padding, and protection against moisture and bending) and for dispatching Orders within a reasonable timeframe.
Buyers are responsible for providing an accurate and complete delivery address. If an Order is shipped to the address provided by the Buyer, delivery issues caused by an incorrect address may be borne by the Buyer.
Shipping methods, tracking, insurance and delivery confirmation may vary by Seller and destination. Where tracking is provided, Sellers must be able to provide proof of shipment and tracking details upon request in case of a dispute.
For international shipments, Buyers may be responsible for customs duties, taxes, and import charges, unless explicitly stated otherwise.
8. Problems with Orders, disputes and Buyer Protection
If you experience an issue with an Order (including non-delivery, damage in transit, or an item that is materially not as described), you must notify Cardpeer as soon as possible and in any case within the reporting timeframe described in our refund policy.
Cardpeer may request evidence to investigate a claim (for example: photos of packaging and item condition, unboxing documentation, tracking information, and communications between Buyer and Seller). Users must cooperate in good faith.
Buyer Protection does not cover ordinary minor differences inherent to physical goods that do not amount to material misrepresentation, nor does it cover “buyer’s remorse” or market price changes.

9. Obligations of the Service
Cardpeer will cooperate with Users with regards to questions that may arise regarding the appropriate provision of services on the Service. Communication shall proceed through Cardpeer support.
Cardpeer will provide reasonable technical support where Users encounter problems related to the functionality of the Service or their account.
10. Termination and enforcement
You may stop using the Service and request closure of your account at any time, subject to completion of any pending Orders, dispute processes, and applicable legal retention obligations.
Cardpeer may suspend or terminate access to the Service if you breach these Terms, engage in fraud or prohibited conduct, misuse payment systems, or otherwise create risk to other Users, Cardpeer, or third parties. Cardpeer may also remove or restrict Listings that violate these Terms or applicable law.
11. Intellectual Proprietary Rights
All right, title, and interest in and to the Service and the website are and shall remain the exclusive property of Cardpeer and third-parties providing facilities and technology for its operation. The Service is protected by copyright, trademark, and other domestic and foreign laws concerning intellectual property. Except as expressly permitted in this Agreement, you may not reproduce, modify, or create derivative works based upon, distribute, sell, transfer, publicly display, publicly perform, transmit, or otherwise use the Service.
Users shall indemnify Cardpeer from any claims of third parties regarding or related to intellectual property infringement by such a User.
The Service displays trademarks, logos, and product names belonging to third-party card game publishers and brands (including but not limited to Pokémon, Nintendo, Creatures Inc., GAME FREAK Inc., Wizards of the Coast, Eiichiro Oda/Shueisha, and Toei Animation). Cardpeer does not claim any ownership rights in these trademarks or any associated copyrighted materials. All such third-party intellectual property is the property of its respective owners. Cardpeer's use of these materials is for descriptive and identification purposes only and does not constitute an endorsement, affiliation, or sponsorship by the trademark owners.
12. Disclaimer of Warranty and Limitation of Liability
To the full extent allowed by applicable law, Cardpeer makes no express or implied warranty or representation regarding the Service including Products offered, sold and purchased, including that the Service including the aforementioned items will meet your requirements or will work in combination with any hardware or software provided by third parties, that the Service will be uninterrupted, without problems or error free, or that all errors in the Service will be corrected.
Cardpeer provides the service "as is" and "as available". You use the Service at your own risk, and the Service may be terminated at any time by Cardpeer or third parties providing facilities and technology for its operation. Cardpeer does not encourage or promote the commercial use of the Service and is under no circumstance liable for any loss or profit as a result of your use of the Service.
To the full extent allowed by applicable law, Cardpeer's warranties and remedies (if any) expressly set forth herein are exclusive and are in lieu of all other warranties, express or implied, either in fact or by operation of law, statute, custom, oral or written statements or otherwise, including, but not limited, to the implied warranties of merchantability, availability, performance, compatibility, fitness for a particular purpose, satisfactory quality, correspondence with description and non-infringement, all of which are expressly disclaimed.
To the full extent allowed by applicable law, in no event shall Cardpeer and its suppliers or licensors have any liability, whether based in contract, delict or tort (including negligence) or strict liability, for incidental, indirect, consequential, special, or punitive damages of any kind, or for loss of revenue or profits, loss of business or goodwill, loss or corruption of, or unauthorized access to, or disclosure of information or data or other financial loss arising out of or in connection with the use, performance, failure, or interruption of the Service, whether foreseeable or not, and even if Cardpeer had been advised of the possibility of such damages. In the event that Cardpeer is found liable to pay you any damages, Cardpeer's total cumulative liability to you under this Agreement shall not exceed EUR 100.00 (one hundred euro). The above limitations of liability will not be affected if any remedy provided herein shall fail its essential purpose.
13. Indemnification
You agree to defend, indemnify, and hold harmless Cardpeer, its officers, directors, affiliates, employees and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service.
14. Amendments
Cardpeer may amend this Agreement or any section of this Agreement, in whole or in part, at any time. Each such amendment will be communicated to you before it’s coming into force. After amendment of the Agreement, each User must accept the amended Terms of Service again before login in to the account and being able to use the Service.
15. Applicable law and settlement of disputes
This Agreement shall be governed by and construed by the laws of the Netherlands.
All disputes arising out of or in connection with the Agreement, or any agreement resulting therefrom, which cannot be settled amicably, shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.
16. Miscellaneous
This Agreement is the entire and exclusive agreement between Cardpeer and you regarding the Service, and this Agreement supersedes and replaces any prior agreements between Cardpeer and you regarding the Service.
If a particular provision of this Agreement is held to be invalid by a court of competent jurisdiction, the provision shall be deemed severed from this Agreement and shall not affect the validity of this Agreement as a whole.
You shall not assign or otherwise transfer this Agreement or any of its rights or obligations hereunder to any third party without the prior written consent of Cardpeer which consent is within Cardpeer's sole discretion. No assignment or delegation by you shall relieve or release you from any of your obligations under this Agreement. Subject to the foregoing, this Agreement shall be binding upon, inure to the benefit of, and be enforceable by each of the parties (i.e. Cardpeer and an individual User) and their respective successors and assigns. Cardpeer shall be allowed to assign this Agreement to any third party without requiring your consent.
Nothing in this Agreement shall constitute a partnership or joint venture between you and Cardpeer.
